Ruf um Unterstützung aus der Türkei

Sehr geehrte Damen und Herren,

Mein Name ist N.N., ich bin die Ehefrau eines verhafteten Richters in der Türkei. Nach einer kurzen Überlegung kam ich auf die Idee, unsere Situation hier, in anderen europäischen Ländern kund zugeben. Nun möchte ich unsere Lage im näheren beschreiben.

Am 15 Juli haben Teile des türkischen Militärs versucht, die Regierung zu stürzen. Ich tadele die Putschisten auf das schärfste. Kaum einige Stunden nach dem gescheiterten Putschversuchs sind in unterschiedlichen Web-sites Namenslisten von 2750 Staatsanwälten und Richtern veröffentlicht worden, mit der Behauptung sie seien in den Putschversuch verwickelt. Da stellt man sich die Frage wann und wie schnell diese Listen zusammengestellt worden sind. Da der Name meines Mannes auch in dieser Liste vorhanden war, war es frustrierend darauf zu warten, bis die Staatsanwältin mit den Polizisten an der Tür stand. Unsere Wohnung und Fahrzeuge wurden bis ins Detail durchsucht.

Mein Mann wurde am 17.07.2016 in X mit einem Haftbefehl festgenommen. Fragte man im Gericht was der Vorwurf sei, so bekamen wir die Antwort dass der Vorwurf einen Datenschutz habe und in der Akte geschützt sei. Das Gericht stellte Fragen zum Lebenslauf die nichts mit dem Putschversuch zu tun haben. Nun werde ich die Fragen auflisten.

1. Welche Schulen haben Sie besucht?

2. In welchen Städten waren Sie als Richter tätig?

3. Wen haben Sie bei dem türkischen hohen Rat der Richter und Staatsanwälte(HSYK) gewählt?

4. Haben Sie irgendwelche Aufträge von dem gefangen Soldaten oder Polizisten bekommen?

5. Stimmen Sie dem misslungenen Putschversuch zu?

6. Haben Sie eine Verbindung zu der Bewegung des Predigers Gülen und seiner Terroristischen Vereinigung?

7. Haben Sie Bezug zu den Geschäftsmännern die, der Terroristischen Vereinigung Gülen angehören.

Mit all diesen lächerlichen und weiteren Fragen die einem Fragebogen ähneln wurde mein Mann ohne Beweise ungesetzlich verhaftet. Ein Grund für dieses Haftbefehl sehe ich nicht ein, da mein Mann seine Arbeit immer in Übereinstimmung mit dem Gesetz und mit Ehre getan hat. Mein Mann ist kein Mitglied irgendeiner Gruppe. Weder einer politischen noch einer religiösen oder terroristischen. Ich bin stolz auf meinem Mann, da er immer mit großer Sorgfalt und großem Fleiß seine Arbeit erledigt hat.

Außerdem möchte ich auch mitteilen das mehr als 3000 Richter und Staatsanwälte in der Türkei suspendiert wurden, also vom Beruf abgesetzt, darunter auch mein Mann. Bemerkenswert ist auch dass, die Regierung das Privatvermögen von diesen Richtern und Staatsanwälten beschlagnahmt. Beschlagnahmt wurden unsere Immobilien, Banknoten und Fahrzeuge. Des Weiteren hat die Regierung sowohl die Reisepässe von den Staatsanwälten und Richtern als auch von den Ehegatten storniert. Da mein Mann vom Beruf entlassen worden ist, sind ich und mein n- jähriger Sohn nicht mehr versichert. Sollten Gesundheitsprobleme auftauchen, so müssen wir dies selber finanzieren oder uns auf hohe Kosten Privat versichern lassen. Stellenweise werden auch Ehegatten vom Dienst ohne jeglichen Grund entlassen.

Ich leide unter diesen schlechten Bedingungen. Somit möchte ich deutlich machen das nicht nur Unterstützer des Putsches, sondern auch Unschuldige festgenommen bzw. vom Beruf entlassen werden, die mit all dem nichts zu tun haben. Daher bitte ich Sie zur Unterstützung.

Hunger Strike of Member of JHC in Turkish Prison

Arrested former president of the second chamber of the judicial High Council, Ms. Nesibe Ozer, started a hunger strike due to the fact that the prison administration has not been allowing her letters and formal petitions to go out of prison and terribly she has been exposed to solitary confinement.

Statement on the position of the Turkish High Council for Judges and Prosecutors in the ENCJ

The ENCJ reiterates its unreserved condemnation of the recent attempted coup in Turkey. The loss of life incurred in this attack on a democratically elected government is inexcusable. Those responsible should be made accountable through an open, fair and impartial judicial process conforming with international standards.

The ENCJ has expressed its concern, both before and after the attempted coup, that the approach of the High Council for Judges and Prosecutors to the transfer, suspension, removal and prosecution of judges has not been consistent with the principles of judicial independence.  The ENCJ has received persuasive information that these procedures have taken place without respecting the principles referred to above.

The board of the ENCJ has repeatedly requested the Turkish High Council for Judges and Prosecutors for details of the procedures followed relating to the extraordinary mass dismissal of thousands of judges and prosecutors and to demonstrate that minimum international standards in relation to disciplinary proceedings against judges and prosecutors have been followed. To date no satisfactory response has been received to these vital inquiries.

As a result of the information that the ENCJ has received and the failure of the Turkish High Council to provide any satisfactory response to it, the board is forced to conclude that the Turkish High Council for Judges and Prosecutors no longer meets the requirements of the ENCJ that it is independent of the executive and legislature so as to ensure the independence of the Turkish Judiciary. The board of the ENCJ has accordingly resolved unanimously to propose to its General Assembly the suspension of the status of Observer to the ENCJ of the HSYK. To this end it has called an extraordinary general meeting which will take place in December 2016.

BEFORE THE ELECTION TO THE HIGH COUNCIL OF JUDGES AND PROSECUTORS (HCJP) THE PRO-GOVERNMENT ASSOCIATION (‘ASSOCIATION OF JUDICIAL UNITY’ – YBD) PREPARED A LIST OF ALL JUDGES and PROSECUTORS TO BLACKLIST THEM

On the list there are names of all Turkish judges and prosecutors and the information about whether they are opponents, or supporters, or in the middle.

This is 1 page of the whole list, after the failed coup attempt, all opponent prosecutors on this page (but Omer Surmeli) got dismissed and detained, most of them are in jail now.

 

SOME BACKGROUND INFORMATION ON PRO-GOVERNMENT ‘ASSOCIATION OF JUDICIAL UNITY’ (YBP, THEN YBD)

Previously it was called ‘The Platform of Judicial Unity’ (YBP – Yargida Birlik Platformu). It was established by the government within the judiciary to promote government affiliated candidates for the high judicial council election membership.

10 members of the High Judicial Council out of 22 are selected by first instance judges and prosecutors. The election was held 12 October 2014. For the government, it was crucial that like-minded people were elected as board member because if it can control the Council it can control the whole judiciary.

The government’s main strategies during the election period were: divide judges and prosecutors by politics, create its own list, demonize part of the judiciary, use all state resources for promoting own candidates, spread false accusations about dissident candidates, use carrot and stick policy, put judicial bureaucracy behind the campaign, win at least 12 seat in total, control Judicial Council, control the whole judiciary.

For achieving this aim, the government created this platform. The government tried to promote his own candidates for the Council membership through these Platform’s activities. Head of judicial commissions, Chief Public Prosecutors, Vice undersecretary of High Judicial Council arranged meetings, invited judges and prosecutors, putting pressure on them, judicial bureaucracy provided venue, transportation and catering for meetings. The government used all its power to persuade judges and prosecutors to vote for them. Intimidation, promising high positions, pay rise, accusing other professional organizations (like YARSAV) as being collaborators of “parallel state” -a term coined by the executive-, demonizing all opponents as “parallel structure”, (Now Gulenists) disseminating black propaganda against all possible candidates… were amongst the tools which were used by them. All state institutions and pro-government media were behind this Platform.

YARSAV refused to be with the government because this is against the very idea of independence of judiciary and supremacy of law and separation of powers.

After the Platform did its job at election and helped the government to have the majority in the supreme judicial council, founders of the government affiliated platform decided to become an association.

With the argument that it is imperative to secure public order, the Turkish Parliament approved a bill declaring the state of emergency and the Council of Europe was informed that Turkey is partially suspending its obligations under the European Convention on Human Rights ( ECHR ).

Not addressing political orientations or matters of public security, strictly from a legal perspective, the author discusses the situation of those under detention in these circumstances and their rights under international law.

After the “Coordination Meeting” held by the Ministry of Foreign Affairs on the 25th of August, 2016, we were informed that “European Committee for the Prevention of Torture” will be visiting Turkey to observe the situation between August 28, 2016 – September 6, 2016, and it was reported that during the visit, Committee may visit any detention center spontaneously in all over the country.

Regarding this,the places like sport halls or etc. will not be used as detention centers, anymore, and all detention and arrest procedures will have to comply with both domestic and international standards and the detention centers must be made suitable for the visits immediately.

It is so ordered.

Their families are struggling with serious financial difficulties,

There are many allegations about torture, inhuman treatments,

They are evicted from their public houses. And trying to rent apartments but no one wants to give them an apartment because they are accused of being members of a terrorist organization,

Their assets were frozen,

Their family life and kids’ school lives have been destroyed,

They are simply trying to survive.

Rule of Law and The Way We Are in the Aftermath of 15th of July

The article by Associate Professor Dr. iur. Öykü Didem Aydın, Attorney at Law, President of Lawyers and Human Rights Defenders Without Borders in Turkey, Member of the Venice Commission, describes the constitutional and statutory ground for declaring a state of emergency and for enacting decrees having force of law (decree-law) under a state of emergency in order to understand what the government is combatting and its procedural and principle limitations. Then she continues with the practices emanating from the declaration and examines whether they are in line with their constitutional and statutory foundation as well as with international standards for basic rights and fundamental freedom.

Neben der Europäischen Richtervereinigung (European Association of Judges/EAJ) ist deshalb auch die Schweizer Vereinigung der Richterinnen und Richte SVR-ASM – wie viele andere nationale Richtervereinigungen – in der letzten Woche (das Interview wurde am 30. President Erdoğan gradually took control of all government institutions. To create his single man regime, he wanted to control not only the legislative and administrative power, but also the judiciary, the media, universities and even civil society.

The article mentions Constitutional provisions, the Criminal Procedure and Criminal Law which are applicable for criminal investigation, pre-trial detention etc. regarding judges and prosecutors in Turkey. It also mentions the law on judges and prosecutors on the basis of which 2745 judges and prosecutors were arrested. It the article the author shows clearly that the actually still on-going criminal investigation and court procedures after the attempted coup against prosecutors and judges, hence many cases of pre-trial detention, are illegal – even under the assumption that the emergency decrees issued by the President of State, Erdoğan, are justified (which one can argue). The author also treats the (il-)legality of the seizure and possible ensuing confiscation of fortune of detainees. The English text of the author’s article has not been modified.

Decision of the 8th of August 2016 of the General Assembly of the Constitutional Court on Removal Measure regarding the Constitutional Court Members Alparslan Altan and Erdal TERCAN

 Translation of the decisive part of the Turkish Constitutional Court decision. Previous parts of the decision are only copy-paste of the indictment of the Chief Prosecutor of Ankara. It was difficult to translate it because the expression of the text is very vague and is not depending on facts.

As you will see there is no single proof against Alparslan Altan and Erdal TERCAN. These two members strongly deny any connection with any illegal organisation, they want to see concrete information and documents against them any they want to defend themselves after they see those documents. They also want their witness to be heard.

But the General Assembly of Constitutional Court decides that, according to Code Nr 667 Statutory Decree article 3, they don’t need concrete proofs and when they have an impression that members have slightest tie with some groups which are described dangerous by the National Security Council they can be dismissed.

Even today there is no terror organisation as “FETÖ/PDY” recognised by the Court of Cassation. But probably Turkey will have new terror organisation invented by the executive power in a very near future.

  1. The Assessment of Removal Measure About the Constitutional Court Members Alparslan Altan and Erdal TERCAN
  2. By relevant authorities it is considered that the coup attempt, which was started at 15.07.2016 night and continued until next day, is planned and implemented by “FETÖ/PDY” – “Fethullah Gülen Terror Organisation/Parallel State Structure”, which is described as a threat for national security by National Security Council (MGK) and have long been subject to investigations and prosecutions in recent years.
  3. The judiciary investigations started and detention measures have been implemented on the FETÖ/PDY members working at the Turkish Armed Forces (TSK), law enforcement agency and judicial institutions which are considered primary institutions by FETÖ/PDY.
  4. The Chief Public Prosecutor of Ankara has initiated an investigation in relation to the offence of attempting to abolish the constitutional order by force and violence and as part of this investigation Constitutional Court Members Alparslan Altan and Erdal Tercan are detained on 16.07.2016 by the accusation of being member of FETÖ/PDY.
  5. Those members are being arrested on 20.7.2016 after their interrogation by the “criminal justice of peace” for the accusation of being member of armed terror organisation. On 1.8.2016 criminal justice of peace imposed a cautionary judgement on the properties of those members.
  6. Members Alparslan ALTAN and Erdal TERCAN denied all allegations against them during their criminal investigation.
  7. In this process, the General Assembly of Constitutional Court is decided to assess the legal situations of members Alparslan ALTAN and Erdal TERCAN according to Code Nr 667 Statutory Decree article 3, which is regulating the measures taken after declaration of state of emergency.
  8. Written defences of members Alparslan ALTAN and Erdal TERCAN are taken by the General Assembly of Constitutional Court. In their defence mentioned members declared that they have no connection with FETÖ/PDY and they demanded an opportunity to defence themselves, after concrete information and documents presented to them in relation to the allegation against them. They also demanded their witnesses to be heard.
  9. The assessment in the context of Code Nr 667 Statutory Decree is not similar to the criminal or disciplinary investigation which enquiries concrete action. The assessment simply indicates a process to form an opinion whether Constitutional Court members have a connection with any group or not. For this reason relevant members will be assessed according to available information and documents.
  10. The assessment of the General Assembly of Constitutional Court about members Alparslan ALTAN and Erdal TERCAN in the context of Code Nr 667 Statutory Decree article 3 will be related to whether mentioned members have any link with the parallel state structure in the “membership”, “affiliation”, “junction” or “contact” form. For this assessment it is sufficient to form a conviction at the majority of the General Assembly
  11. Considering, the above expressed features of the present case, social network information indicates their relation to the aforementioned structure and common impression of Constitutional Court members formed during the time, it is assessed by the General Assembly that members Alparslan ALTAN and Erdal TERCAN have connection with “the structure” in the context of Code Nr 667 Statutory Decree article 3. For this reason it is assessed that it is not proper to let them stay in their profession.
  12. Considering the main function of the Constitutional Court, as a protector of democratic constitutional order and basic rights and freedoms, it is clear that to let those members to stay in their profession will damage reliability and dignity of the judiciary.
  13. For the reasons described above, it is necessary to decide that it is not appropriate to let members Alparslan ALTAN and Erdal TERCAN to stay in their profession and they must be dismissed.

VERDICT

For the reasons described above;

  1. According to Code Nr 667 Statutory Decree article 3,

it is unanimously decided on 4.8.2016 that

  1. The Constitutional Court Member Alparslan ALTAN’s remain at the profession is not appropriate and he is dismissed
  1. The Constitutional Court Member Erdal TERCAN’s remain at the profession is not appropriate and he is dismissed
  2. The decision will be noticed to those concerned

  1. Anayasa Mahkemesi Üyeleri Alparslan ALTAN ve Erdal TERCAN Hakkında Meslekten Çıkarma Tedbirinin Uygulanıp Uygulanmayacağına İlişkin Değerlendirme
  2. 15 Temmuz 2016 gecesi başlayıp ertesi gün belli bir saate kadar devam eden darbe teşebbüsünün planlayıcısı ve uygulayıcısının, uzun süredir soruşturma ve kovuşturmalara konu olan, son dönemde MGK tarafından “millî güvenliği tehdit eden bir terör örgütü” olarak tanımlanan FETÖ/PDY olduğu yetkili makamlarca değerlendirilmiştir.
  3. FETÖ/PDY’nin örgütlenmesi bakımından önem verdiği kurumların başında gelen TSK, emniyet teşkilatı ve yargı kurumlarında görev yapan çok sayıda askeri personel, emniyet görevlisi ve yargı mensubu hakkında darbe teşebbüsü sonrası ülke genelinde soruşturmalar başlatılmış ve gözaltı tedbirleri uygulanmıştır.
  4. Ankara Cumhuriyet Başsavcılığınca anayasal düzeni cebir ve şiddet kullanarak ortadan kaldırmaya teşebbüs etme suçuna ilişkin olarak başlatılan soruşturma kapsamında Anayasa Mahkemesi Üyeleri Alparslan ALTAN ve Erdal TERCAN da “FETÖ/PDY üyesi” oldukları gerekçesiyle 16/7/2016 tarihinde gözaltına alınmışlardır.
  5. Anılan üyelerin farklı sulh ceza hâkimlikleri tarafından yapılan sorgularının ardından 20/7/2016 tarihinde “silahlı terör örgütüne üye olma” suçundan tutuklanmalarına karar verilmiştir. Sulh ceza hâkimliği tarafından 1/8/2016 tarihinde bu üyelerin malvarlıkları üzerine tedbir konulmuştur.
  6. Üyeler Alparslan ALTAN ve Erdal TERCAN, ceza soruşturması kapsamındaki ifadelerinde üzerlerine atılı suçu kabul etmediklerini beyan etmişlerdir.
  7. Bu süreçte darbe teşebbüsü sonrası ilan edilen olağanüstü hâlin uygulanmasına ilişkin tedbirleri düzenleyen 667 sayılı KHK’nın 3. maddesi uyarınca Anayasa Mahkemesi Genel Kurulu tarafından Üyeler Alparslan ALTAN ve Erdal TERCAN’ın hukuki durumlarının değerlendirilmesine karar verilmiştir.
  8. Anayasa Mahkemesi Genel Kurulunca yapılacak değerlendirmede dikkate alınmak üzere Üyeler Alparslan ALTAN ve Erdal TERCAN’ın yazılı savunmaları alınmıştır.  Anılan üyeler savunmalarında FETÖ/PDY ile herhangi bir bağlarının bulunmadığını beyan etmişler; yöneltilen suçlamayla ilgili somut bilgi ve belgeler kendilerine sunulduktan sonra yeniden savunma imkânı verilmesini, isimlerini belirttikleri bazı tanıkların dinlenilmesini talep etmişlerdir.
  9. 667 sayılı KHK kapsamında yapılacak değerlendirme, adli suç veya disiplin suçu niteliğindeki somut bir eylemin soruşturulması mahiyetinde olmayıp Anayasa Mahkemesi Üyelerinin belli bir yapıyla herhangi bir bağlarının olup olmadığına ilişkin kanaatin oluşturulacağı bir süreci ifade etmektedir. Dolayısıyla KHK’nın amacı ve tedbirin niteliği ile somut olayın özellikleri birlikte dikkate alındığında ilgili üyeler hakkında mevcut bilgi ve belgelere göre değerlendirme yapılması gerekmiştir.

Anayasa Mahkemesi Genel Kurulunun, Üyeler Alparslan ALTAN ve Erdal TERCAN hakkında 667 sayılı KHK’nın 3. maddesi uyarınca yapacağı değerlendirme, anılan üyelerin MGK’ca devletin milli güvenliğine karşı faaliyette bulunduğuna karar verilen yapı, oluşum veya gruplardan MGK kararlarında ifade edildiği şekliyle (bkz. § 18) “Paralel Devlet Yapılanması” ile “üyelik”, “mensubiyet”, “iltisak” veya “irtibat” şeklinde herhangi bir bağlarının olup olmadığına ilişkindir. Yukarıda ifade edildiği üzere bu değerlendirme için Genel Kurulun salt çoğunluğunda anılan üyelerle ilgili oluşacak “kanaat” yeterlidir.
  11. Somut olayın yukarıda ifade edilen özellikleri, anılan yapı ile ilgileri olduğuna dair sosyal çevre bilgisi ve Anayasa Mahkemesi Üyelerinin zaman içinde oluşan ortak kanaatleri birlikte dikkate alınarak, Üyeler Alparslan ALTAN ve Erdal TERCAN’ın KHK’nın 3. maddesinin (1) numaralı fıkrası kapsamında söz konusu yapı ile meslekte kalmalarıyla bağdaşmayacak nitelikte bağlarının olduğu değerlendirilmiştir.
  12. Durumları bu şekilde değerlendirilen üyelerin, temel görevi demokratik anayasal düzen ile temel hak ve hürriyetleri korumak olan Anayasa Mahkemesinde görev yapmaya devam etmesinin yargının güvenilirliğini ve saygınlığını da zedeleyeceği açıktır.
  13. Açıklanan nedenlerle Üyeler Alparslan ALTAN ve Erdal TERCAN’ın meslekte kalmalarının uygun olmadığına ve meslekten çıkarılmalarınakarar verilmesi gerekir.

According to this source: the number of dismissals of civil servants at any state institution is 42.881

The President of YARSAV (Turkish Judges Association) Mr. Murat Arslan is also dismissed.

Thursday decree also cancelled passports of spouses of all people who have been blamed for being a member of the FETO organization

The decree also calls retired judges and prosecutors to duty if they wish.

All members of ‘Prison Monitoring Boards’ (Cezaevi Izleme Kurullari) dismissed. New members will be appointed in 10 days. (This is important: These boards monitor the conditions of prisons all over the country. So, why will the government appoint new members? Is this to hide ill treatments and torture?)
